Terms of Service

These terms govern your use of Kinbook, a service operated by David Pinkerton, based in Australia. By creating an account or contributing to a book project, you agree to these terms. If anything here is unclear, email kinbook@dpinkerton.com.
Who can use Kinbook
You must be at least 16 years old to create a Kinbook account. Contributors invited to a project by a book owner can participate at any age with the owner's responsibility. You are responsible for keeping your account credentials secure.
Your content
You retain ownership of everything you contribute — voice recordings, photos, text, and the books that result. You grant Kinbook the permission we need to run the service on your behalf: to store your content, process it through our AI pipelines, and deliver it back to you and the people you've invited to your project.
You are responsible for the content you contribute and for having permission to share it. Please don't upload material that isn't yours to share, that infringes someone's rights, or that violates applicable law.
AI-generated output
Kinbook uses third-party AI models to weave contributions into book chapters. AI-generated text can occasionally contain errors, misattributions, or fabrications. You are responsible for reviewing chapters before treating them as final or sharing them outside the project. We provide editing and approval tools for exactly this reason.
Acceptable use
Please don't:
- Use Kinbook to harass, impersonate, or cause harm to anyone.
- Upload malware, attempt to breach our systems, or disrupt the service for other users.
- Use the service for commercial content farming, bulk automated contributions, or anything unrelated to personal stories and memories.
- Reverse-engineer or attempt to extract the underlying AI models or prompts.
Payment and refunds
Paid plans renew on the cadence you selected (monthly or annual). You can cancel anytime from your account settings; cancellation takes effect at the end of the current billing period. We don't offer automatic refunds for the unused portion of a billing period, but if something has clearly gone wrong, email us and we'll make it right.
Prices are shown in Australian dollars (AUD). International customers are billed in local currency at checkout, based on Stripe's conversion rates.
Account termination
You can delete your account at any time from your settings. We retain data for a 30-day cooling-off period in case of accidental deletion — see the Privacy Policy for details.
We may suspend or terminate accounts that violate these terms or that remain completely inactive for an extended period. Where possible, we'll give you reasonable notice and an opportunity to export your content first.
Service availability
Kinbook is provided on an "as is" basis. We work hard to keep the service reliable, but we can't guarantee uninterrupted availability. We may make changes to features, pricing, or the service itself from time to time; material changes will be communicated in advance.
Liability
To the maximum extent permitted by law, Kinbook's total liability for any claim relating to the service is limited to the amount you paid to Kinbook in the 12 months preceding the claim. We're not liable for indirect, consequential, or incidental damages — including loss of data beyond what's covered by our backup and retention practices described in the Privacy Policy.
Nothing in these terms limits rights you have under Australian consumer law or equivalent protections in your jurisdiction.
Governing law
These terms are governed by the laws of New South Wales, Australia. Disputes will be handled in the courts of New South Wales, unless applicable consumer law grants you rights to bring proceedings elsewhere.
Changes to these terms
If we update these terms in any material way, we'll let you know by email and update the "Last updated" date above. Continued use of the service after a change means you accept the updated terms.
